Husqvarna Branded Products sold via Internet websites.

In a letter dated November 2009, Sebastian Poccard, Husqvarna Outdoor Products Managing Director, has asked that the following information be provided:
'Dealers must ensure that any customer who purchases products online is aware that it is a requirement of Husqvarna Outdoor Products that products be fully assembled, pre-delivery inspected and all safety functions tested prior to being handed over to customers. Products may only be handed over to customers in a ready to use condition, with all relevant documentation and any tools or accessories that should be supplied included.'
Furthermore, in a letter dated 15th December 2009, Husqvarna Brand Marketing Manager Andy Eastaugh requires that the following statement appear on all dealer websites where Husqvarna products are offered for sale:
"Husqvarna Outdoor Products is committed to maintaining a premium brand and to ensuring that 'Husqvarna' branded products are distributed appropriately to customers. As such, all 'Husqvarna' branded products must be fully assembled, pre-delivery inspected and tested prior to being handed over to customers. Any 'Husvarna' branded products that are purchased online must be either collected by the customer from the relavant dealer or be delivered direclty to the customer by the relevant dealer. We at Stanton Hope feel that the reference to Husqvarna products in the above statement is intended to mean machines (e.g. chainsaws), as we feel that assembly, pre-delivery inspection and testing of products such as lubricants, PPE and marking tools would not be relevant.
